Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to the terms. The Native State reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your use of the Site following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed. USAGE RESTRICTIONS; INTELLECTUAL PROPERTY
All of the content you see and hear on the Site, including but not limited to, page headers, images, illustrations, graphics, audio clips, video clips, and text are subject to trademark, service mark, copyright and/or other intellectual property rights are held by The Native State or by third parties who have granted permission to The Native State to use their materials. No use of these may be made without prior written consent.

The content of the Site, and the Site as a whole, is intended solely for the personal, non-commercial use by the users of our site. You may download, blog, print or store selected portions of the content, provided you give credit to The Native State and source back to www.thenativestate.com.

PAYMENT
We use Stripe to collect/process transaction information for credit and debit card payments. Please refer to Stripe's security policy. If using Clearpay (UK Residents only) then please refer here to Clearpay’s terms of use.

When an order is placed, you will receive a confirmation email from The Native State. Please check this information carefully. We cannot be held responsible for failed delivery due to incorrect or incomplete postal addresses. When an order is placed full payment is required. This is also the case for pre-orders. Once we receive your payment, we will begin processing your order and will send you an email to confirm when the order has been shipped. If you have a discount or promotional code this must be used at checkout. Discount or promotional codes can not be applied once an order has been placed.

TAX CHARGES
The Native State is not VAT registered at this time and does not charge VAT. The prices shown are in pound sterling.

SHIPPING
We cannot be held responsible for delays incurred by Royal Mail or postal services within your country of residence. Nor can we be held responsible for failed delivery due to incorrect or incomplete postal addresses. If items are returned to us due to a failed delivery then postage costs will not be refunded.

BACKORDERS
We will make every effort to keep online stock levels up to date. In the event of errors, we will contact you by email. A full refund is always offered and you will have the choice to wait for the item to come back into stock or if this is not possible, to choose a replacement item. 

COLOURS
We have done our best to display as accurately as possible the colours of the products shown on the Site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate. 

CORRECTION OF ERRORS AND INACCURACIES
The information on the Site may contain typographical errors or inaccuracies and may not be complete or current. We, therefore, reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We apologise for any inconvenience this may cause you. If you are not fully satisfied with your purchase please see our Returns policy. This does not affect your statutory rights.

TYPOGRAPHICAL ERRORS
In the event of a product being listed on the Site at an incorrect price due to typographical error or systems error, The Native State shall have the right to refuse or cancel any orders placed for a product listed at the incorrect price. The Native State shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, The Native State shall issue a payment to your credit card account in the amount of the incorrect price and any other charge related to the order.

USE OF SITE
Harassment in any manner or form on the Site or any other site relating to The Native State, for example, but not limited to, Facebook, Instagram, Twitter, and including via email and chat or by obscene or abusive language is strictly forbidden. If you want to share something, please be nice.

INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Native State and Francesca Kerr-Dineen its employees, and suppliers from and against all losses, expenses, damages and costs, including resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account. Impersonation of others on the site is strictly prohibited.

THIRD-PARTY LINKS
In an attempt to provide increased value to our visitors, The Native State may choose various third-party websites to link to from its own site. However, even if the third party is affiliated with The Native State, The Native State has no control over these linked sites, all of which have separate privacy and data collection practices, independent of The Native State. The Native State has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such websites. These linked sites are only for your convenience and therefore please access them at your own risk.

LIMITATION OF LIABILITY
The Native State or Francesca Kerr-Dineen shall not be liable for any special or consequential damages that result from the use of the products sold on this Site. We will always take reasonable care to store the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer should a third party acquire unlawful access to any data you provide when browsing or ordering from our Site.

CANCELLATION POLICY
Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any of our products within a period of 7 working days, beginning with the day after the day on which the product is delivered. This applies to all of our products.

In the event of cancellation, products must be returned to the above address and the customer will be responsible for the cost of return. We recommend using some form of "signed for delivery."

TERM; TERMINATION
These terms and conditions are applicable to you upon your accessing the Site/ or completing the registration or shopping process. These terms and conditions, or any of them, may be terminated by The Native State without notice at any time for any reason. The provisions relating to Limitation of Liability and Indemnification shall survive any termination.
